This Notice describes how the Practice collect, use and process your information, and how, in doing so, we comply with our legal obligation to you in accordance with the Protection of Personal Information Act (Act 4 of 2013) (POPIA).
Our practice policy is to respect the privacy of our clients, their families and our staff.
- When you visit the practice website, the Weebly platform obtains basic data from your device (for example IP address) in order to service our account with them. The information that Weebly may collect from you during a visit are specified in their Privacy Notice at https://termsandprivacy.weebly.com/privacy-en.html#_Toc27134591.
- We collect basic personal data (your name and e-mail address, and additional information you provide) when you make contact with the practice through our website. The information you provide enables us to respond to your enquiry.
- We collect and store your basic personal identification data (intake form) in order for us to adhere to administrative requirements of the practice.
- We collect and store sensitive personal information about you (practice file) in order for us to continually assess, treat and manage your clinical best interest, or to fulfil a mandate given by you to investigate a matter of a psycho-legal nature and compile a report.
- We collect and store visual images of therapeutic case work for practice supervision and/or professional training purposes. We sometimes also collect information by means of video recording during psycho-legal interviewing. These interviews are transcribed and electronically stored as potential evidence in a court of law and may also be used for the purpose of professional training. Case studies are presented anonymously and/or, if required, depersonalised by making changes to material to protect privacy. However, you will still have to give permission for information from your practice file to be used for training.
- We will use your personal information only for the purposes for which it was collected and agreed with you.
- We may disclose your personal information on a need-to-know basis to our service providers who are involved in our service delivery to you. We have agreements in place to ensure that they comply with the privacy requirements obligated by POPIA.
- We will not disclose your personal information of a sensitive nature (for example, health or psychological status) to a third party without your permission, unless there are exceptional circumstances (for example, a life or death situation) or we are required by law for certain information to be passed on.
- Every staff member at the private practice has a contractual duty to keep information about you confidential.
- We will be reviewing our security controls and related processes on a continuous basis with a view to ensuring that your personal information remains protected.
- You have the right to request a copy of the personal information we hold about you, and you have the right to rectify such information if applicable.
- We adhere to the record keeping rules of the Health Professions Council of South Africa (HPCSA) with regards to disposal of your personal information.
